Everton have lodged an appeal over their second points deduction.
The candies were docked two points earlier this month and will now launch a formal appeal against his punishment for breaching the Premier League's financial rules.
The appeal process must be concluded by May 24, five days after the final match of the Premier League season on May 19.
The Toffees have yet to secure relegation safety and are currently just two points away from the drop on 27 points.

Meanwhile, other relegation candidates Nottingham Forest They have also been awarded a four-point deduction this season for breaching Premier League financial rules.
Forest, who are one place below Everton in the table and one point away from relegation, have also lodged an appeal against the decision.
