Former Brazilian footballer Dani Alves he began serving a four-and-a-half-year sentence for rape after he was convicted in February, although that sentence is pending appeal. Both the state prosecutor and the victim have also appealed the sentence.
Ace for Relief, the state prosecution and the victim, both of whom were accused in the case, want Alves' sentence to increase. The 40-year-old was given that length of sentence based on the fact that he had provided €150k in damages to the victim, which the judge considered a mitigating circumstance, thus reducing the sentence.
The minimum sentence for the crime committed by Alves is four years, and the maximum is twelve. The victim's lawyer has not yet formalized his appeal, but the state maintains that the €150,000 was not in line with the defendant's means, and thus should not be considered a mitigating circumstance. Likewise, Alves has not accepted his sentence (pleading not guilty) or shown regret, which means he cannot be considered reparative.
Meanwhile, Alves' defense continues to argue for bail until the appeal process is resolved, and they are trying to reduce the sentence even further with their appeal. So far it has not been released since it was given at the end of January 2023, since it was considered a flight risk. If the court considers that the victim has been well compensated, Alves' sentence could be reduced to just two years, more than a year of which he has already served.
Even if the current sentence is maintained, Alves could be allowed to leave prison during the days of July this year, while he could be allowed out of his sentence after serving three quarters, he must qualify because of good behavior.
